Public policy is an important element in determining the arbitrability of a dispute, and also a ground on which an award may be annulled or refused enforcement. It has often been said that the public policy should be construed narrowly in keeping with the pro-arbitration policy of the New York Convention or the UNCITRAL Model Law.

 


Perhaps less mentioned is how arbitrator independence and seat court review are so fundamental and universal that they form part of the “international public policy” of arbitration. In contrast to such an “international public policy” is the different notion that a court can enforce an award that has been annulled by the seat court if it regards the annulment to be against the enforcing court’s own public policy, whether it relates to crime, sanctions, corruption, bankruptcy, sovereignty or other concerns. Are the notions of “international public policy” and country public policy the opposite of one another or can and should an enforcing court consider as part of its own public policy (1) “international public policy”, (2) the public policy of the country of the governing law, (3) the public policy of the country of the seat of arbitration, and (4) how to resolve conflict between different public policies?

The Singapore Mediation Lecture is presented by the Singapore Mediation Centre (SMC) and Harry Elias Partnership LLP, in collaboration with the Singapore Management University.  The Lecture series is held annually with the aim to enhance the understanding and use of mediation in resolving commercial disputes.

 

This year’s lecture will focus on the types of long-term commercial contracts that involve a high degree of communication, collaboration and co-operation by the parties (i.e. the characteristics of a ‘relational contract’ under English law) and how disputes arising from such contracts can be resolved. In this regard, our keynote speaker and panellists will discuss the options including the SMC’s new scheme – Integrated Appropriate Dispute Resolution Framework or INTEGRAF, in which a Conflict Avoidance Board is constituted to help preserve relations and resolve disputes throughout the span of long term projects.

 

The keynote address will be delivered by The Right Honourable Lord Justice Peter Fraser, Royal Courts of Justice, Law Commission of England and Wales. The address will focus on relational contracts under English law as described in Alan Bates and Others v Post Office Limited [2019] EWHC 606. This will be followed by a discussion by our esteemed panellists on such contracts and INTEGRAF.

 

The lecture is suited for mediators, adjudicators and dispute resolution advocates who want a better understanding of the workings of a conflict avoidance board and how it helps in diffusing large scale disputes.

 

The lecture will also be combined with an Appreciation Lunch for the SMC's mediators, adjudicators and dispute resolution advocates. We are pleased to welcome those who wish to meet with like-minded participants and widen individual networks.

Motion: This House believes that an Integrated Dispute Resolution (IDR) Mechanism, allowing a Resolver to freely select from Arbitration, Mediation or Negotiation, is the most efficient way to resolve maritime disputes of the future.  

 

Will maritime disputes of the future be most efficiently resolved through contractually agreed ADR mechanisms such as arbitration or mediation? Or should ADR mechanisms be dynamically determined only after a dispute has arisen, taking into account the nature and circumstances of the dispute?


This debate motion proposes that maritime disputes of the future would be most efficiently resolved through an Integrated Dispute Resolution (IDR) Mechanism, which allows a Resolver to freely choose among Arbitration, Mediation, or Negotiation, after a dispute has arisen. This approach is argued to provide unmatched flexibility, potentially speeding up the resolution process by aligning the method more closely with the specific stages and characteristics of each dispute, resulting in significant reductions in both time and costs.


However, detractors point out that the absence of a predetermined mechanism might undermine consistency and predictability, which are essentially elements of fairness in dispute resolution. Such a mechanism integrating different methods of dispute resolution could introduce unwelcome complexity and inefficiency, rather than streamlining the process. There is also a concern about the possible influence of a Resolver's personal preference or specific expertise on their choice of resolution method, potentially skewing outcomes.


Debaters will spar over the concept of an Integrated Dispute Resolution (IDR) mechanism. Can IDR be effective as ADR?

With each passing year, States are seeking to increase the ambition of their mitigation actions, due to both international commitments and climate change litigation. In this regard, COP29 in Dubai was a breakthrough: a call to transition away from the use of fossil fuels to meet the goals of the Paris Agreement is contained in the text of the Global Stocktake (GST). Mitigation measures have a dual effect. On the one hand, significant legislative amendments and economic diversification are required to ensure energy transition and carbon neutrality, placing a financial burden on States. On the other hand, these actions could have an effect on existing investments, including those from conventional investors in fossil fuels. In the end, States may find themselves incurring costs twice: once for the energy transition and again for the expropriation of investors’ assets.
  
These complexities suggest that Investor-State Dispute Settlement (ISDS) will be used more often to challenge the climate policies of States. During the panel discussion, the speakers will explore the tools available to States for adopting climate change policies while balancing them with investment protection. Particular attention will be given to the safeguards in place for investors to protect their investments, including issues related to expropriation, compensation, and its calculation.

 

The discussion will be of interest to both academicians and practitioners in the field of investor-State arbitration related to energy and decarbonisation. Participants may gain insights into latest legal developments, case studies, and emerging trends at the intersection of law, investments, and climate change.
